Aerial Pole Academy (APA) 2024 Terms and Conditions
Please take the time to read the Aerial Pole Academy Terms and Conditions for classes, memberships, workshops and event registrations. They will apply to all persons registering to Aerial Pole Academy.
MEMBERSHIPS & PAYMENT POLICY
Memberships are made online via Aerial Pole Academy website. Once you have filled out your membership form and made a full or part payment you will be registered with a membership with APA. All APA packages are GST inclusive. Minimum 12 Month Memberships have a 7 day cooling off period from the date of purchase for the membership to be terminated.
Please know that places are not reserved in APA classes, workshops or events without payment. All payments must be made in accordance with your membership agreement. The attendee’s registration may be cancelled and APA reserves the right to claim all payment due otherwise if payments are missed or not paid in accordance to the agreement. Aerial Pole Academy reserve all rights to refuse registration of a potential participant if it feels that individual may breach the Terms and Conditions here within.
Aerial Pole Academy accepts online registrations to register for an APA student payment plan membership. Registrants must fill in the membership registration form that can be found on the Aerial Pole Academy website.

PAYMENT AND REFUND POLICY
These terms set out your rights and obligations with respect to your payment and enrollment including important limitations and conditions on your right to obtain a refund. Your payment for a term at APA constitutes your agreement that these policies apply, so be certain you understand them before you enroll. Each term started requires payment to be completed in full.
Refunds, or the transfers of fees to another term, may only be granted by the discretion of APA management.
MEMBERSHIP PAUSING
6 term Unlimited and Rose Gold Memberships may be paused upon request for up to 1 term per contract period, all other Rose Gold & Unlimited Memberships may be paused upon request for up to 1 term per contract period if a medical certificate is provided. Pausing of a membership may only be paused for the period a full term, a few weeks or days at a time are not permitted to be paused.
24 Hour Memberships may be paused for up to 4 weeks upon request at any time throughout the calendar year. Pausing must be done in weekly blocks.
Suspension periods are not included in the membership contract's minimum duration.
NO SHOW & CANCELLATION FEES FOR UNLIMITED MEMBERS
A $5 no show fee will be charged to your account if you book a class and do not attend, a $5 cancellation fee will be charged to your account if cancel a class with less than 12 hours notice.
CANCELLATIONS AT THE DISCRETION OF APA
APA reserves the right to change the class timetable up to and including the date of the course if sufficient bookings have not been received. In the event of the timetable being altered, every effort will be made to avoid inconvenience by offering alternative dates or times. If we are unable to offer a suitable alternative course a refund will only be granted at the discretion of APA management. We are unable to give refunds or transfer classes to another term for any reason.
CANCELLATION AND TRANSFERS
No refunds or transfers will be made for cancellations.
APA reserves the right to refuse the transfer.

CONFIRMATION OF MEMBERSHIP
Confirmation of your Membership at Aerial Pole Academy will be sent to you via email by PaySmart once you have filled in your payment plan details. Your confirmatory email forms a legally binding contract, once you receive the email from PaySmart acknowledging that your registration has been received and successfully processed and you agree to make payment of the full amount of your selected package. We will not be responsible if you fail to receive confirmation because you have supplied us with an incorrect email address. If you do not receive your confirmation email within two business days, please send an email to [email protected] to make sure that we have received registration.

FORCE MAJEURE
Aerial Pole Academy will not be liable for any default or delay in the performance of its obligations, to the extent that such default or delay is caused, directly or indirectly, by an event beyond the reasonable control of Aerial Pole Academy such as, but not limited to: fire, flood, earthquake, elements of nature, acts or regulations of government bodies, court orders, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, strikes, lockouts or labour difficulties. Such event or circumstance giving rise to the default or delay is a Force Majeure Event.
DATA PROTECTION
By accepting the present Terms and Conditions you accept the personal information provided by you to be held on Aerial Pole Academy database. Aerial Pole Academy will not sell, trade, or transfer such personal information to third parties. Aerial Pole Academy may use your personal information for marketing, advertising or product/service offering purposes. For example, we could use your information for direct emailing of our newsletters, online surveys or notifications.

PHOTOGRAPHY
All visitors acknowledge that they may be photographed or filmed by Aerial Pole Academy's photographer/videographer, and consent to their image being used in promotional material by the organiser.
LIABILITY AND INSURANCE
All participants must be 18 years old or older to be able to participate in the APA and will be required to fill out and sign a risk assessment waiver before participating in any workshops.
Aerial Pole Academy will not assume any responsibility whatsoever for any damage or injury to persons or property during the event or trainings. The registrant is recommended to arrange their personal travel and health insurances.
Aerial Pole Academy shall have no liability for loss or damage to any of your personal property except where this is due to the negligence of Aerial Pole Academy. Aerial Pole Academy will not be liable for any indirect or consequential loss suffered by you; or any loss of property or personable (direct or indirect) suffered by you. Aerial Pole Academy total liability to you in contract, (including but not limited to negligence) or otherwise shall not exceed the relevant fee paid.
APPLICABLE LAWS AND COMPETENCE
The relationship between Aerial Pole Academy and the registrant will be exclusively governed and constructed within the laws of Australia without giving effect to any principles of conflicts of law. If no agreement can be reached, any dispute related to the commercial relation will be taken in charge by the exclusive competence of the Australian jurisdiction.
PARTICIPANT CONDUCT
All participants must be respectful of the APA staff, trainers, instructors, and coaches throughout the program. Inappropriate or offensive behaviour and/or language will not be tolerated at any time. Aerial Pole Academy reserves the right to remove the guest from the premises if they behave in a manner unreasonable or potentially disruptive towards Aerial Pole Academy or the well being of other guests, its organisers or staff members.
NO SMOKING
All Aerial Pole Academy areas are non-smoking. Anyone who wishes to smoke may do so outside of the building. We appreciate your cooperation.
